Terms of Service
Effective date: 1 March 2026
1. Who We Are
Zendu (Pty) Ltd (“Zendu”, “we”, “us”) operates an online marketplace connecting customers who need home and business services (“Customers”) with independent service providers (“Providers”). Zendu is not a contractor, employer, or agent of any Provider. We provide the technology platform only. All services are performed directly between Customers and Providers under agreements they reach independently.
2. Acceptance of Terms
By registering on the Platform you agree to be bound by these Terms of Service and our Privacy Policy. We may update these terms from time to time. Continued use constitutes acceptance of revised terms. We will notify Providers of material changes via SMS or in-app notification.
3. Provider Eligibility
By registering as a Provider, you confirm that you are at least 18 years of age; legally entitled to work in South Africa; hold any licences or certifications required by law for your stated trade; will provide services with reasonable care and skill; and will not misrepresent your qualifications or experience.
4. Subscriptions and Fees
Access to job leads requires an active paid subscription. Fees are displayed during registration and in your dashboard. Subscriptions are billed in advance via PayFast and renew automatically until cancelled. Fees are non-refundable except as required by the Consumer Protection Act 68 of 2008. During any free trial period, Zendu will give reasonable advance notice before the first charge is applied.
5. Job Leads and Matching
Zendu does not guarantee a minimum number of job leads or that any Customer will engage you. The Platform facilitates introductions only. Once a Customer engages you, all agreements, payments, and liability for quality of work are entirely between you and the Customer.
6. Provider Conduct
Providers must respond honestly and professionally; not solicit Customers via channels outside the Platform to circumvent Zendu’s subscription model; not engage in discriminatory, abusive, or fraudulent conduct; maintain valid public liability insurance where required; and comply with all applicable South African laws. Violations may result in immediate suspension without refund.
7. Limitation of Liability
Zendu’s total liability for any claim is limited to subscription fees paid in the three months preceding the claim. Zendu is not liable for indirect, consequential, or special loss arising from interactions between Customers and Providers. Nothing limits liability that cannot be excluded under the Consumer Protection Act or other mandatory South African law.
8. Governing Law
These terms are governed by the laws of the Republic of South Africa. Disputes shall be referred to arbitration under the Rules of the Arbitration Foundation of Southern Africa (AFSA) in Gauteng.
